L'Assemblea Mondiale della Salute si prepara per il voto sul Trattato pandemico
L'Organizzazione Mondiale della Sanità (OMS) si sta preparando per un momento importante con l'avvicinarsi dell'77ª Assemblea Mondiale della Salute il 28 maggio 2024. Una proposta di Risoluzione del Trattato pandemico sarà presentata durante questa assemblea, che include il progetto del trattato e una richiesta per la sua immediata attuazione.
Il trattato, dettagliato nella proposta di Trattato pandemico disponibile a questo link, richiede al Direttore Generale di avviare attività sotto diversi articoli, tra cui l'Articolo 6.5, l'Articolo 7.3, l'Articolo 13.1, l'Articolo 13.6, l'Articolo 14, l'Articolo 20.3 e un Articolo 10.6 (che non esiste nella versione attuale della proposta di trattato).
Tuttavia, sembra che il trattato non sia ancora pronto per la ratifica immediata. Nessun paese ha annunciato piani per introdurre il trattato in vigore per il 28 maggio 2024. Il trattato può essere firmato solo dopo che il sistema di condivisione dei benefici dell'accesso ai patogeni è stato completato e adottato, un processo previsto per l'79ª Assemblea Mondiale della Salute nel maggio 2026, seguito dai processi di ratifica successivi.
Le trattative per il trattato sono rimaste bloccate su diversi aspetti chiave, come la Salute Unica (Articoli 4-5), il sistema di accesso e condivisione dei benefici dei patogeni (PABS) (Articolo 12), il finanziamento (Articolo 20) e la Conferenza delle Parti (Articolo 21). Questi ritardi hanno portato a preoccupazioni sul fatto che il trattato sia incompleto, con alcuni che affermano che il Corpo di Negoziazione Intergovernativo (INB) sta ricorrendo a trattative di ricatto, esercitando pressioni sui paesi membri dell'OMS per adottare un accordo incompleto.
Despite the challenges, preparations are underway for the convening of the first session of the Conference of the Parties, following the entry into force of the Agreement. Rules of procedure for the Conference of the Parties and criteria for participation of observers at sessions of the Conference of the Parties are to be established (Article 21.5). A draft budget for the first financial period is also to be prepared.
The One Health InterGovernmental Working Group and the PABS InterGovernmental Working Group have been tasked with submitting their outcomes for consideration by the Seventy-eighth World Health Assembly no later than May 31, 2026, with the goal of making the WHO Pathogen Access and Benefit-Sharing System operational by that date.
The resolution, which can be found at this link, also requests preparations for making the treaty available for signing during the upcoming 77th World Health Assembly, as soon as May 28, 2024. If nations do not sign the unfinished document immediately, they will not be able to participate in subsequent negotiations to work out the details.
As the deadline for the treaty's signing approaches, the future of the Pandemic Treaty remains uncertain. The negotiations for the treaty are on the verge of failing, with the success of the treaty hinging on the ability of the INB to reach consensus among the 194 member nations.
