In recent developments, several western states are considering the legalisation of sports betting, following a wave of changes in the eastern and southern regions of the United States.

Montana, partially grandfathered into limited sports betting when the Professional and Amateur Sports Protection Act (PAPSA) was passed in 1992, currently offers sports tab games, sports pools, and daily fantasy sports. The Gambling Control Division in Montana has a $1 tax on sports tabs, but sports pools are more popular, with no taxes or fees charged on bars or establishments offering them.

David Barden, CEO of the New Mexico lottery authority, is considering a lottery game tied to football game scores, but not involving any actual handicapping. The next session of the New Mexico legislature begins on Jan. 15, 2019, and this potential new game could be one of the topics under discussion.

Meanwhile, Montana state senator Mark Blasdel (R) has expressed skepticism about the revenue potential of expanded sports betting in Montana. State senator Blasdel's concerns are shared by some, as the sports pools in Montana demand that pools be designed so that the total of each participant's wager(s) does not exceed $100, the total value of all prizes equals the total of all wagers, and the total value of all prizes awarded does not exceed $2,500.

The Montana Lottery operates two fantasy games that generate minimal revenue. However, Neil Peterson, executive director of the Gaming Industry Association of Montana, has expressed optimism about the potential for Nevada-style sports wagering options in Montana.

Across the border in Arizona, gaming compacts with more than 20 tribes limit the types and number of games allowed at casinos and require the tribes to contribute 1-8 percent of gaming revenue to state and local governments. Arizona has taken in over $1 billion since 2002, when casino gambling became legal in the state.

Colorado's Attorney General found that commercial sports betting falls outside the restrictions in the state's constitution. Despite this, Colorado voters previously voted against the idea of expanding gambling, and the state began sports betting legalization in May 2020.

In contrast, Utah remains one of the few states without a lottery and has no tribal casinos. Sports betting is unlikely to become legal in Utah due to opposition from the Church of Jesus Christ of Latter-day Saints and the state's largely Mormon constituency.

Idaho's state constitution currently prohibits all types of gambling except for a state-sanctioned lottery, pari-mutuel betting typically used in horse racing, and bingo or raffle games operated by qualified charitable organizations.

Wyoming allows gambling in the form of tribal casinos, bingo, pull tabs, live horse racing, historical horse racing, poker rooms, and card games for money among friends. The Wyoming legislature will convene again on Jan. 8, 2019, and may consider legislation to regulate sports wagering.

Six states have either legalized sports wagering or issued licenses since the Supreme Court struck down the Professional and Amateur Sports Protection Act on May 14. This trend indicates a growing acceptance of sports betting across the United States, with more states expected to follow suit in the coming years.
